Thriftplate Terms of Use

Effective date: October 25, 2026

These Terms of Use ("Terms") are an agreement between you and Nguyen Thi Chi, My Dinh, Nam Tu Liem, Hanoi, Vietnam ("we", "us") for the Thriftplate mobile app (the "app"). By using the app, you agree to these Terms and to our Privacy Policy (https://thriftplate.tunacorp.app/privacy). If you don't agree, don't use the app.

1. Who can use the app

You must be at least 18 years old (or the age of majority where you live, if higher) to use the app.

2. What the app does

The app uses artificial intelligence (AI) to suggest weekly meal plans, recipes, cooking steps, and grocery lists based on what you tell it, and lets you import and save your own recipes. You don't need an account; the app creates an anonymous app account on your phone. If you delete the app or change phones, your data may be lost.

3. AI content, allergies, and food safety

Please read this section carefully.

• AI can be wrong. Meal plans, recipes, amounts, and steps are made by AI and may be incomplete, inaccurate, or unsuitable for you. Use your own judgment before cooking or eating anything.
• Allergies and diets. We check AI recipes against the allergies and diet you choose, but we can miss things, and packaged foods can contain hidden allergens or traces from shared equipment. Always read food labels yourself. Recipes you import or add yourself are not filtered; the app only warns you about ingredients it recognizes. If you have a severe allergy or a medical condition, follow your doctor's advice.
• Food safety. Cook meat, poultry, seafood, and eggs to safe internal temperatures, and store food safely.
• Not health advice. The app doesn't provide nutrition, health, dietary, or medical advice, and it isn't designed for weight loss or for any medical condition.
• Budget. Your budget is a guide for the AI when it picks ingredients. We don't show or promise prices. What you actually spend depends on your store, location, prices, and what you buy.

4. Subscriptions and free use

• Free use. You can use the app for free within the free limits shown in the app. We may change free limits at any time.
• Pro. Pro is an auto-renewing subscription sold through the Apple App Store or Google Play. The price, billing period, and any free trial are shown before you buy.
• Auto-renewal. Your subscription renews automatically at the end of each period at the then-current price until you cancel. If you start a free trial, you will be charged when the trial ends unless you cancel at least 24 hours before it ends.
• Cancelling. Cancel anytime in your App Store or Google Play account settings. Deleting the app or using Delete my data does not cancel your subscription. After you cancel, Pro stays active until the end of the period you paid for.
• Payments and refunds are handled by Apple or Google under their terms. We can't issue refunds directly; request them from Apple or Google.
• Price changes. If the price changes, Apple or Google will notify you as their rules require, and you can cancel before the new price applies.
• Restore. Use Restore purchases to get Pro back on a new install or phone signed in to the same store account.

5. Fair use

To keep the service working for everyone and to prevent abuse, Pro includes generous usage limits. Currently: up to 10 new meal plans per 7 days, 50 meal swaps per 24 hours, and 30 recipe imports per 24 hours. Each period starts with your first use of that feature and lasts 24 hours (7 days for meal plans); your count resets when it ends. We may adjust these limits; if we lower them in a way that meaningfully reduces your Pro features, we'll tell you in the app. Retrying after an error on our side does not count toward your limits.

6. Your content

• "Your content" means what you put into the app: your answers, recipes, links, text, photos, and edits. You keep all rights to your content.
• You give us permission to store, copy, and process your content, and to send it to our service providers (including our AI provider, as described in the Privacy Policy), only to run the app for you. This permission ends when you delete your content, except for copies our providers delete on their own schedule as described in the Privacy Policy.
• Only import recipes and photos you have the right to use. Imported recipes are for your personal, non-commercial use. We save the link and the recipe details you import; we don't copy images from other websites to our servers.
• Your saved recipes stay viewable, editable, and deletable even if you don't subscribe or your subscription ends.

7. Acceptable use

Don't: use the app for anything illegal; try to get around free limits, payment checks, or security; access our servers or AI features other than through the app; copy, resell, or scrape the app or its content at scale; upload content that is unlawful, infringing, or harmful, or that contains other people's personal data without permission; or try to make the AI produce harmful content.

8. Our app and content

We and our licensors own the app, its design, illustrations, and software. We give you a personal, non-transferable, revocable license to use the app on devices you own or control, under these Terms and the store's rules. AI-generated meal plans and recipes are provided for your personal use.

9. Third-party services

The app relies on third-party services (such as Apple, Google, and RevenueCat) and links to other websites (such as the source of an imported recipe). We don't control them and aren't responsible for their content or practices.

10. Changes and ending use

We may update the app, add or remove features, or stop the app, with notice in the app where reasonable. We may update these Terms; if a change is material, we'll tell you in the app before it takes effect. You can stop using the app at any time. We may suspend access if you seriously or repeatedly break these Terms.

11. Disclaimer

To the fullest extent the law allows, the app and all content, including AI content, are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee that the app will be uninterrupted or error-free, or that any meal is free of a particular allergen or ingredient. Some places don't allow these exclusions, so some may not apply to you.

12. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the app or any content. Our total liability for any claim related to the app is limited to the greater of the amount you paid us for the app in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence where that rule applies.

13. Your rights as a consumer

Nothing in these Terms takes away rights you have as a consumer under the law where you live that can't be waived or limited by contract. For example, if you live in Australia, Brazil, Canada, or another country with mandatory consumer guarantees, sections 11 and 12 apply only as far as that law allows, and we remain responsible for damage caused by our gross negligence or intentional misconduct where that law says so.

14. Governing law and disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of mandatory rules of the law where you live. Disputes will be resolved by the competent courts in Hanoi, Vietnam, but if you are a consumer you can also bring a claim in the courts where you live. Before filing a claim, please contact us at tunacorp.app@gmail.com so we can try to resolve it.

15. Apple App Store terms

If you got the app from the Apple App Store:

• These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Your license is limited to using the app on Apple-branded products you own or control, as allowed by the App Store Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for any claims by you or a third party about the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection, privacy, or similar claims.
• If a third party claims the app infringes its intellectual property, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
• You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
